Welcome to Amee Jee. These Terms of Service (“Terms”) explain how you may use our website ameejee.com (the “Site”) and purchase our products and services (together, the “Services”).

By browsing the Site, creating an account or placing an order, you agree to be bound by these Terms, together with our Privacy Policy, Shipping & Delivery Policy and Refund & Returns Policy (together, the “Agreement”). If you do not agree, you must not use the Site or place an order.

In these Terms, “Amee Jee”, “we”, “us”, “our” means Amee Jee Ltd, and “you”, “your” means the person using the Site or buying our products.

Our online store is hosted by Shopify Inc., which provides the e-commerce platform we use to sell our products to you.

1. Eligibility and Online Store Use

1.1 By using the Site or placing an order, you confirm that:

you are at least 18 years old, and
you are legally capable of entering into a binding contract.

1.2 If you allow another person (including a minor dependent) to use your account or place an order on your behalf, you are responsible for their actions and for ensuring they comply with these Terms.

1.3 You must not use the Site or our products:

for any illegal or unauthorised purpose, or
in a way that violates any applicable laws or regulations.

1.4 You must not upload or transmit viruses, malware or any other harmful code.

1.5 If we reasonably believe you have breached these Terms, we may suspend or terminate your access to the Site or Services immediately.

2. General Conditions

2.1 We may refuse to provide the Services to any person, or limit orders, where we reasonably consider it necessary (for example, to prevent misuse or fraud).

2.2 You understand that any content you submit or upload to the Site (excluding payment card details) may be transferred over various networks and adapted to meet technical requirements.

2.3 Payment card information is handled by our payment provider(s) and is always encrypted during transfer over networks.

2.4 You must not reproduce, copy, sell, resell or exploit any part of the Services or Site content for commercial purposes without our prior written consent.

2.5 Section headings are for convenience only and do not affect the interpretation of these Terms.

3. Information on the Site

3.1 We ensure that information on the Site (including product descriptions, ingredients, allergen information, nutritional information, pricing and availability) is accurate and up to date. However, from time to time errors or omissions may occur.

3.2 The material on the Site is provided for general information only and should not be your only source for important decisions (for example, medical, nutritional or allergy-related decisions). Always check the product packaging, labels and ingredients before consuming any product and consult a suitable professional if you have specific dietary or health concerns.

3.3 We may update or change content on the Site at any time, but we are not obliged to update any information except where required by law.

4. Changes to the Services and Prices

4.1 Prices for our products, delivery charges and any promotions are subject to change at any time.

4.3 We will not be liable to you or any third party for any modification, price change, suspension or discontinuation of the Services, but this does not affect any orders that we have already accepted.

5. Products, Food Information and Availability

5.1 Our products are perishable food products. Storage, heating and consumption instructions are provided on the packaging – you are responsible for following these carefully.

5.2 Certain products may be available online only and may be produced in limited quantities. All orders are subject to availability.

5.3 We make every effort to display product images and colours accurately, but we cannot guarantee that your device’s display will show colours or packaging exactly as they appear in person.

5.4 We reserve the right to:

limit sales of products to particular people, households, regions or jurisdictions,
limit the quantities of any products or Services we offer, and
discontinue any product at any time.

5.5 All descriptions of products and pricing are subject to change without notice. Any offer for any product or service on the Site is void where prohibited by law.

5.6 We do not guarantee that the quality of any products, services or information will meet your expectations, but your statutory rights under UK law (including in relation to faulty or mis-described goods) are not affected.

6. Orders, Billing and Account Information

6.1 When you place an order, you are making an offer to purchase products from us. We reserve the right to accept or reject any order.

6.2 We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These limits may apply to orders:

placed under the same account,
using the same payment method, or
with the same billing or shipping address.

6.3 If we change or cancel an order, we will try to notify you using the email address, phone number or billing address you provided when the order was placed.

6.4 We may refuse or cancel orders that, in our reasonable opinion, appear to be placed by resellers, distributors or wholesalers.

6.5 You agree to provide current, complete and accurate purchase and account information for all orders and to keep your email address, billing details and payment information up to date so we can complete your transactions and contact you if needed.

7. Optional Tools and Third-Party Services

7.1 We may provide access to third-party tools or services (such as payment gateways, subscription management tools, or review platforms) that we do not control.

7.2 You acknowledge that:

such tools are provided “as is” and “as available”, without any warranties or representations by us, and
we have no liability arising from or relating to your use of third-party tools.

7.3 Your use of third-party tools or services is entirely at your own risk and is governed by the terms and policies of the relevant third-party provider.

7.4 In future we may introduce new features, services or tools through the Site. Unless we say otherwise, these will also be subject to these Terms.

8. Reviews, Comments and Other User Content

8.1 If you submit reviews, comments, ideas, photos, recipes or other materials to us (collectively, “User Content”), whether via the Site, email, social media or otherwise, you grant us a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, adapt, publish, translate and display such User Content in any media for purposes related to our business (for example, on our website, social channels or marketing materials).

8.2 We are not obliged to:

keep any User Content confidential,
pay you any compensation for User Content, or
respond to any User Content.

8.3 We may, but are not obliged to, monitor, edit or remove User Content which we consider in our sole discretion to be unlawful, offensive, misleading, infringing, defamatory, obscene or otherwise objectionable, or which breaches these Terms or any third party’s rights.

8.4 You agree that your User Content will not:

infringe any third party’s intellectual property or other rights,
contain defamatory, abusive, hateful, obscene or otherwise unlawful material, or
contain viruses, malware or other harmful code.

8.5 You must not use a false identity or mislead us or others as to the origin of any User Content. You are solely responsible for the content and accuracy of anything you submit, and we accept no liability for User Content posted by you or any third party.

9.1 Your submission of personal information through the Site and our store is governed by our Privacy Policy, which explains how we collect, use and protect your data.

10. Errors, Inaccuracies and Omissions

10.2 We reserve the right to correct any errors, inaccuracies or omissions, and to modify or update information or cancel orders if any information in the Service or on the Site is inaccurate at any time, including after you have submitted your order, where permitted by law.

10.3 Except where required by law, we have no obligation to update or amend information on the Site, including pricing information.

11. Prohibited Uses

11.1 In addition to other prohibitions set out in these Terms, you must not use the Site or its content:

for any unlawful purpose,
to violate any applicable laws or regulations,
to infringe our intellectual property rights or those of others,
to harass, abuse, insult, harm, defame, slander, intimidate or discriminate against any person,
to submit false or misleading information,
to upload or transmit viruses or malicious code,
to collect or track personal information about others without their consent,
to spam, phish, scrape, crawl or otherwise misuse the Site, or
to interfere with or circumvent the security features of the Site or any related website.

11.2 We may suspend or terminate your use of the Services if you breach this section.

12. Our Responsibility to You (Disclaimer and Limitation of Liability)

12.1 Nothing in these Terms excludes or limits our liability for:

death or personal injury caused by our negligence,
fraud or fraudulent misrepresentation, or
any other liability that cannot be excluded or limited under UK law.

12.2 The Site and Services are provided “as is” and “as available”. To the fullest extent permitted by law, and except as set out in our Refund & Returns Policy and your statutory rights, we do not give any guarantee or warranty that:

the Site or Services will be uninterrupted, timely, secure or error-free, or
the content on the Site will always be accurate or up to date.

12.3 If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of this contract or our negligence, but we are not responsible for any loss or damage that is not foreseeable.

12.4 We only provide the Site and Services for domestic and private use. If you use the Site or products for any commercial or business purpose, we will have no liability for any loss of profit, loss of business, business interruption or loss of business opportunity.

12.5 Subject to clause 14.1, our total liability to you in respect of any claims arising out of or in connection with the Agreement will not exceed the total amount you have paid to us for the product(s) or Services in question in the 12 months preceding the claim.

Your statutory rights as a consumer are not affected.

13. Indemnity

You agree to indemnify and hold harmless Amee Jee Ltd, our directors, officers, employees, affiliates, agents and service providers from and against any third-party claims, liabilities, damages, losses, costs or expenses (including reasonable legal fees) arising out of:

your breach of these Terms or any other applicable policies, or
your violation of any law or third-party rights.

14. Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, or, if not possible, severed from the Terms. This will not affect the validity and enforceability of the remaining provisions.

15. Termination

15.1 These Terms apply for as long as you use the Site or Services.

15.2 You may stop using the Site at any time and may request to close your account.

15.3 We may suspend or terminate your access to the Site or Services at any time where we reasonably believe you have breached these Terms or where we cease providing the Services. You will remain responsible for all amounts due up to the date of termination.

15.4 Sections that, by their nature, should continue after termination (including payment obligations, intellectual property, limitation of liability and indemnity) will remain in effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, Shipping & Delivery Policy and Refund & Returns Policy, constitute the entire agreement between you and us regarding your use of the Site and Services and supersede any prior agreements or understandings between us.

If we do not enforce any right or provision under these Terms, that does not mean we have waived that right or provision.

17. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) are governed by the laws of England and Wales.

You and we both agree that the courts of England and Wales will have exclusive jurisdiction, except that if you live in Scotland or Northern Ireland, you may bring legal proceedings in your local courts.

We may update these Terms from time to time. The most current version will always be available on this page and will show the “Last updated” date at the top.

If we make significant changes, we may also notify you by email or by a notice on the Site. Your continued use of the Site or Services after changes are posted means you accept the updated Terms.
